Details relating to an employee’s gender transition or their transgender falls within a “special category of personal data” under the General Data Protection Regulation, which came into force on 25 May 2018. Employers have a duty to keep records accurate, therefore it is important to ensure that if an employee undergoes gender transition, that their records are updated with their new gender and new name (if applicable) as soon as possible.
We are encouraging employers to continuously review how such data is processed to ensure transition is as smooth as possible.
